TERMS AND CONDITIONS OF SALE
IMPORTANT INFORMATION, CUSTOMIZED PRODUCTS:
Air conditioner covers, pot covers and outdoor fittings sold by GLOBALU are custom-made to order (specific dimensions, RAL colors of choice, cutting patterns). In accordance with article L.221-28 3° of the French Consumer Code, these products are excluded from the 14-day right of withdrawal. By validating your order, you expressly acknowledge that production will start immediately, and you waive your right of withdrawal. No returns or refunds for personal reasons will be accepted once production has started.
This Returns and Refunds Policy applies to all orders placed on the globalu.fr website or on our partner marketplaces. It complies with the provisions of the French Consumer Code, in particular Articles L.221-18 et seq. concerning the right of withdrawal, and Articles L.217-3 et seq. concerning the legal guarantee of conformity.
1. No right of withdrawal, personalized products
1.1. Principle
In accordance witharticle L.221-28 3° of the French Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of goods made to the consumer’s specifications or clearly personalized.
All products sold by GLOBALU (exterior and interior air conditioner covers, planters, screens, folding screens, planter covers) are custom-made by Société Industrielle d’Équipement de la Limagne (SIEL) according to the customer’s specifications:
- Custom dimensions (height, width, depth) ;
- Cutting patterns and decorative ranges ;
- Choose from the RAL color chart (over 200 shades available) or specific colors.
As these products are made specifically to order for each customer, they are excluded from the 14-day right of withdrawal.
1.2. Express acknowledgement by the Customer
By validating his order, the Customer expressly acknowledges :
- That the production of his personalized product starts immediately after validation of the payment;
- That he waives his 14-day right of withdrawal pursuant to article L.221-28 3° of the French Consumer Code;
- Thatno returns, exchanges or refunds for personal convenience will be accepted once production has begun;
- That he alone is responsible for the accuracy of the measurements and specifications communicated at the time of ordering.
The customer is reminded of this information at the time of ordering, on the product sheet concerned and during the basket validation stage.
2. Damaged, non-conforming or defective products
Despite the absence of a right of withdrawal, the customer benefits from the legal guarantees in the event of a damaged, non-conforming or defective product.
2.1. Receiving inspection
The customer must check the condition of the packaging and the product in the presence of the carrier at the time of delivery.
In the event of damage (damaged packaging, damaged product, opened package), the Customer must imperatively :
- Make precise and detailed reservations on the carrier’s delivery note (the simple mention “subject to unpacking” is insufficient);
- Take photos of the product and packaging, inside and out;
- Refuse delivery if the damage is obviously serious.
2.2. Reporting to GLOBALU
The customer must inform GLOBALU within 72 hours of receipt, at [email protected], by enclosing :
- Order number ;
- Photos of product and packaging;
- A copy of the delivery note with any reservations;
- A precise description of the defect or non-conformity.
The product and its packaging must be kept until instructed by us.
2.3. Proposed solutions
After analyzing the file, GLOBALU will proceed to :
- Free shipment of a replacement part;
- Complete product replacement ;
- Full refund of the order, including product and shipping costs.
3. Legal warranties
In accordance with the legal provisions in force, the customer benefits from the following guarantees, independently of the GLOBALU commercial guarantee.
3.1. Legal warranty of conformity (articles L.217-3 to L.217-17 of the French Consumer Code)
The customer has a period of 2 years from the date of delivery of the goods to take action under the legal warranty of conformity. During this period, he/she may obtain free compliance of the product by repair or replacement, without having to prove the existence of the lack of conformity.
This guarantee applies in particular if the product received does not correspond to the specifications of the validated order (error of color, dimensions or pattern attributable to GLOBALU or its manufacturer SIEL). It does not apply to measurement errors communicated by the customer.
Defects in conformity appearing within 24 months of delivery are presumed to have existed at the time of delivery, unless proven otherwise.
3.2. Warranty against hidden defects (articles 1641 to 1649 of the French Civil Code)
The customer may also invoke the warranty for hidden defects in the goods sold, as defined in article 1641 of the French Civil Code, if the product has a manufacturing defect making its use impossible or dangerous. In this case, the customer may choose between rescinding the sale or reducing the price, in accordance with article 1644 of the French Civil Code. The action must be brought within 2 years of discovery of the defect.
3.3. Legal warranties
To make use of your legal warranty, please contact us at [email protected], specifying your order reference, a precise description of the defect and enclosing photos. You may be asked to provide proof of identity and proof of purchase.
4. GLOBALU commercial warranty, 10 years Qualilaquage
In addition to legal warranties, GLOBALU offers a 10-year commercial warranty on the Qualilaquage powder-coating of its aluminum products.
4.1. Scope of warranty
The 10-year warranty covers :
- UV resistance of powder coating ;
- No abnormal discoloration of the coating;
- No chipping, blistering or corrosion under normal conditions of use;
- Qualilaquage-certified coating resistance.
4.2. Commercial warranty exclusions
The commercial warranty does not cover :
- Damage resulting from improper installation or use;
- Damage caused by impact, scratching or vandalism;
- Damage resulting from the use of unsuitable or aggressive cleaning products;
- Normal wear and tear and the natural evolution of the coating’s appearance;
- Damage caused by an aggressive marine or industrial environment, unless the product has been specifically ordered for such environments;
- Modifications or repairs carried out by the customer or an unauthorized third party.
4.3. Implementation of the commercial warranty
To make a claim under the commercial warranty, contact us at [email protected], enclosing your invoice, photos of the product and a precise description of the defect. After assessment, GLOBALU will repair, replace or refund your money as soon as possible.
5. Customer’s liability
GLOBALU shall not be held responsible for :
- Measurement errors communicated by the customer when ordering (height, width, depth of air conditioning unit or heat pump);
- Incorrect installation of the air-conditioning cover by the customer or a third party, resulting in damage to the air-conditioning unit or its support;
- Use of the product in conditions not covered by the installation and maintenance instructions.
It is the customer’s responsibility to check the accuracy of the measurements entered before validating the order. In case of doubt, our customer service is at your disposal to help you choose the right dimensions for your equipment.
6. Refund
6.1. Cases giving rise to reimbursement
A refund may be granted in the following cases:
- Product does not conform to the specifications of the validated order (legal guarantee of conformity) ;
- Product with a hidden defect (warranty against hidden defects) ;
- Product damaged in transit, with reservations duly made on delivery ;
- Cancellation of the order by GLOBALU before the start of production.
6.2. Repayment terms and conditions
Refunds are made within a maximum of 14 days from the date of validation of the file by GLOBALU. It is carried out using the same means of payment as that used for the initial transaction (Payplug, Alma, or marketplace platform), unless the customer expressly agrees to another means. No fees are charged to the customer for the refund.
7. Provisions applicable to professionals (B2B)
The provisions relating to legal warranties of conformity set out in the French Consumer Code (article L.217-3 et seq.) do not apply to orders placed in the context of a professional activity via the Espace Pro.
However, professionals benefit from the following guarantees:
- The GLOBALU 10-year commercial warranty Qualilaquage under the conditions defined in article 4;
- The warranty for hidden defects provided for in articles 1641 to 1649 of the French Civil Code ;
- The specific conditions specified in our General Terms and Conditions of Sale Pro, accessible via the Espace Pro.

9. Consumer mediation
In accordance with articles L.611-1 et seq. of the French Consumer Code, in the event of a dispute that has not been resolved amicably, the consumer may have free recourse to the consumer mediator appointed by GLOBALU :
Referral to the mediator is only admissible after an initial written request has been made to GLOBALU without a satisfactory response within two months.

10. Applicable law
This Returns and Refunds Policy is governed by French law. In the event of a dispute, an amicable solution will be sought before any legal action is taken. Failing this, the competent courts will be those defined in article 9 of the General Terms and Conditions of Sale and article 12 of the Legal Notice.
